On January 16, 2021, Article 30 of the Law of Ukraine "On Ensuring the Functioning of the Ukrainian Language as the State Language" came into effect.

Key Legislative Requirements on the State Language in Educational Institutions
Article 30 of this law pertains to the education sector. Educational institutions are legal entities providing educational services, which include a range of actions according to the educational program or agreement, aimed at achieving the expected results for students (Clause 18, Part 1, Article 1 of the Law of Ukraine "On Education").

Language of the Educational Process in Educational Institutions
According to Article 7 of the Law of Ukraine "On Education", the language of the educational process in educational institutions is the state language. The state guarantees every citizen of Ukraine the right to receive formal education at all levels (preschool, general secondary, vocational (vocational-technical), pre-university, and higher education), as well as extracurricular and postgraduate education, in the state language in state and municipal educational institutions.

Persons belonging to national minorities and indigenous peoples of Ukraine are guaranteed the right to receive preschool and primary education in the language of the relevant national minority or indigenous people, alongside the state language, in municipal educational institutions.

All Educational Institution Employees Must Be Proficient in the State Language
Officials and employees of enterprises, institutions, and organizations of state and municipal ownership, including the leadership of educational institutions, education administration staff, pedagogical, research, and scientific-pedagogical employees (excluding foreigners or stateless persons invited to educational institutions or research institutions to work temporarily as scientific, pedagogical, or language instructors), are required to be proficient in the state language and use it while performing their duties (Article 9 of the Law of Ukraine "On Ensuring the Functioning of the Ukrainian Language as the State Language").

The State Language Is the Working Language of Communication in Educational Institutions
In accordance with Part 1 of Article 12 of the Law of Ukraine "On Ensuring the Functioning of the Ukrainian Language as the State Language", the state language is the working language of communication for enterprises, institutions, and organizations of state and municipal ownership, including the language used during meetings, events, and gatherings.

The state language must be used during working hours by scientific-pedagogical, pedagogical, and other employees of educational institutions.

The state language must be used throughout the educational process, during lessons (except for subjects that, according to the educational program of the institution, are taught in foreign languages or the languages of indigenous peoples and national minorities), and in communication between teachers, lecturers, and other staff of educational institutions, both with students (learners) and among themselves (Letters of the Ministry of Education and Science No. 1-9-581 from 17.09.2019 "On the Use of the State Language in the Educational Process" and from 01.02.2018 No. 1/9-74 "Letter on the Use of the Ukrainian Language in Education").

State Language in Consumer Services in Education
While the above requirements primarily apply to state and municipal educational institutions, Article 30 of the Law of Ukraine "On Ensuring the Functioning of the Ukrainian Language as the State Language" stipulates that all economic entities must serve consumers in the state language.

In the education sector, this applies to educational institutions, enterprises, institutions, organizations of all forms of ownership, and individual entrepreneurs providing educational services.

Thus, education of any level and form—whether full-time, part-time, distance learning, network learning, external studies, homeschooling, etc.—as well as the provision of educational services, teaching of any profession, online education, television/radio lessons, and postal education, must be conducted in the state language.

By Order No. 852-r of the Cabinet of Ministers of Ukraine dated July 8, 2020, Taras Dmytrovych Kremny was appointed as the authorized representative for the protection of the state language.

The authorized representative for the protection of the state language is an official whose status, powers, and the procedure for their implementation are defined in Section VIII: PROTECTION OF THE STATE LANGUAGE(Articles 49-57) of the Law of Ukraine "On Ensuring the Functioning of the Ukrainian Language as the State Language."
